Terms of Service
- Version 1.4Effective 2026-10-30
Describes the paid plans (Directory Pro, Featured, Managed Pro, Growth Partner, Elite) and what managed plans do and do not include; deals rules; setup fees for Growth Partner and Elite (shown at checkout), charged on the first invoice and non-refundable once work starts, with only the difference due when you move up; ad spend is paid to Google or Meta directly and is never collected by us, with a 15% management fee on managed spend above $2,500 a month, and a recommendation (not a commitment) to stay on Elite for at least 3 months; founding pricing per plan; how upgrades, downgrades and stopped plans work; and AI usage in the Hub is billed by usage along with texting and calling, at our provider's usage rates plus 5%; names the contracting entity (LIVINGRGV LLC); requires you to be at least 18; refunds the unused part of prepaid fees if we end your paid membership for a reason other than your breach; adds a Governing Law and Venue section (Texas law, Hidalgo County, Texas courts, no arbitration); and caps liability at the greater of the fees paid to LivingRGV in the prior 12 months or US$100. Paid plans renew monthly until cancelled, and you can cancel anytime in your dashboard, on every plan including Elite.
- Version 1.3Effective 2026-10-27
If you claim a listing, every claim is now reviewed before the listing changes hands; we approve businesses owned or operated in the Rio Grande Valley and may ask for verification. You can choose a paid tier while your claim is reviewed: your card is saved and you authorize a charge when the claim is approved, after which the subscription renews monthly until cancelled; a declined claim is never charged. Adds a Text Messages section for the optional RGV Weekly Deals program: how to join, 1 msg/week plus a confirmation text, message and data rates, STOP to opt out and HELP for help. Quote requests you submit may be shared with a limited number of local businesses in that trade serving your area (which may include Featured members), and LivingRGV may contact you about them by phone, text message or email; a message sent from a listing's own page still goes only to that business.
- Version 1.2Effective 2026-10-03
Adds a subsection on texting and calling in the LRGV Hub, the HighLevel-powered CRM included with Featured. States that business texting and calling are billed separately by usage, charged by LivingRGV through its payment processor, at cost plus payment processing fees, from a prepaid balance on the member's card that reloads automatically when it falls below a minimum amount; that HighLevel runs the Hub but does not bill members; that underlying rates are set by carriers and HighLevel, passed on at cost, and are not stated in these Terms; that members are responsible for the legal and carrier compliance of messages and calls they send; that texting and calling may be suspended for abuse or non-compliance. Amends the Creator Marketplace section's statement of the money LivingRGV handles to include Hub usage. No other section changed.
- Version 1.1Effective 2026-07-30
Adds the Creator Marketplace section in the present tense, and names the marketplace in the opening scope sentence, for the launch of creator profiles. States that hiring is between the business and the creator, that LivingRGV is not a party to it, that no payment for creative work passes through the platform, and that we do not guarantee work quality or payment. No other section changed.
- Version 1.0Effective 2026-07-29
Initial draft. Not reviewed by counsel.
Privacy Policy
- Version 1.8Effective 2026-10-27
If you use Fill in from flyer when submitting an event, we keep a record of each use (the time and the size of the request to our AI provider) to enforce a daily limit and track its cost. If you are signed in it is linked to your account; if you are signed out it holds only a scrambled form of your IP address, never the address itself.
- Version 1.7Effective 2026-10-27
If you request a quote on a trade page or use an estimate tool, we now describe what we collect (your name, email address, phone number, ZIP code and request) and that we may share it with a limited number of local businesses in that trade serving your area, which may include Featured members, so they can contact you. Adds our optional RGV Weekly Deals text-message program (1 message a week, plus a confirmation text) and updates the newsletter description: when you sign up we record your phone number or email address, the exact wording you agreed to and its version, the time, the page, and your browser details; for texts also your IP address, for the newsletter only a scrambled form of it (the separate abuse-prevention record holds a request's IP address, as for every form). We honor STOP and unsubscribe requests immediately, and in any event within 10 business days, and keep consent records for five years. Names Anthropic, our AI provider, which reads an event flyer you upload only if you choose to have it fill in the event form for you. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.
- Version 1.6Effective 2026-10-21
Discloses the chat widget on our public website, provided by HighLevel (LeadConnector). Your name, phone number, and the messages you send through the widget are processed by HighLevel. The widget keeps a session identifier and your conversation history in your browser's local storage. The chat form shows LIVINGRGV LLC's consent statement for promotional texts and calls beside an optional checkbox; message frequency varies, msg & data rates may apply, reply STOP to opt out and HELP for help. No mobile information is shared with third parties or affiliates for marketing or promotional purposes. Names the operating entity, LIVINGRGV LLC, and its mailing address.
- Version 1.5Effective 2026-10-03
Discloses that business members — people who submit, claim, or accept an invite to manage a listing, and existing members through their dashboard — are asked for a mobile phone number, which is required to become a member and is stored on their account. It is used to contact them about their account and listing, and for text messages only if they separately opt in: alerts when a customer messages their business, and deals and tips from LivingRGV. Each text consent is optional and separate, and is recorded with the number, the exact wording shown, the time, the IP address, and the form it was given on. Reply STOP to opt out or HELP for help; message frequency varies and message and data rates may apply. States that no mobile information is shared with third parties or affiliates for marketing or promotional purposes, and that text opt-in data and consent are not shared with any third parties. Adds HighLevel (LeadConnector), which provides the LRGV Hub CRM to Featured members, as a subprocessor; Hub texting and calling usage is charged by LivingRGV through Stripe.
- Version 1.4Effective 2026-08-27
Discloses the LivingRGV newsletter. Separates transactional email — which cannot be switched off while a listing is active — from the newsletter, which is a separate and explicit opt-in that is never added from a claim, a business submission, or a contact message. States what a subscription stores: email address, the city selected if provided, the subscription date, and a hashed record of the IP address used only to prevent automated signups. States that the list is not sold, rented, or shared, that every issue carries a one-click unsubscribe, and that an opt-out is recorded so an address is not re-added. Replaces v1.3's statement that we do not send marketing email, which the newsletter made false. No new subprocessor, no new cookie, and no change to advertising or to interaction counting.
- Version 1.3Effective 2026-08-07
Discloses first-party interaction counting on creator profiles: profile views, marketplace impressions, messages started, taps on a creator's listed email or phone, social link opens, and portfolio video plays — and that these totals are shown to the creator about their own profile. States that the content of a message is not part of these counts. Extends the 400-day automatic deletion to cover them, matching the window already applied to listing interaction counts. No new subprocessor, no new cookie, and no change to advertising.
- Version 1.2Effective 2026-08-04
Discloses the Meta advertising pixel and Conversions API: what is sent, that email is hashed rather than sent in readable form, and that this is targeted advertising under Texas law. Discloses the YouTube embed, which sends IP and user-agent to Google when the video area renders — an omission present since the video shipped and independent of advertising. Adds the advertising opt-out with its real limits: on by default, not retroactive, stored per browser, reset by clearing site data.
- Version 1.1Effective 2026-07-31
Discloses first-party interaction counts (listing views, action-button taps, coupon visibility, search impressions) recorded in our own database rather than through Google Analytics, and states what those records contain and what they deliberately omit — no IP address, no user-agent, no account identifier, only a daily-rotating random session token used for de-duplication. Adds the business-facing disclosure that a claimed listing's owner sees counts for its own page. Replaces the Data Retention section: v1.0 stated that no automated deletion exists anywhere in the system, which a 400-day purge of interaction events makes untrue. Clarifies that these counts are not sent to Google. No other section changed.
- Version 1.0Effective 2026-07-29
Initial draft. Accuracy-audited against code; not reviewed by counsel.
Creator Portfolio Licence
- Version 1.1Effective 2026-08-04
Adds video to the portfolio grant: moving images, their audio, and the automatic processing (encoding, thumbnails, poster frames, multiple resolutions) required to play them back. Adds a rights statement about music and audio specifically. No change to which surfaces the work may appear on.
- Version 1.0Effective 2026-07-29
Initial version. Operator-approved wording; not reviewed by counsel.
Creator Promotional Use
- Version 1.0Effective 2026-07-29
Initial version. Operator-approved wording; not reviewed by counsel.
Text Message Consent
- Version 1.1Effective 2026-10-03
Replaces the long v1.0 disclosure with the checkbox wording shown on every member sign-up form, now that a mobile number is required for membership (v1.0 said it was optional and used only for these messages). Adds message frequency, HELP, and links to the Terms and Privacy Policy.
- Version 1.0Effective 2026-07-31
Initial version. The text a user sees beside the SMS opt-in checkbox: who sends, that consent is not required to use LivingRGV, approximate frequency, message-and-data-rates, and STOP to unsubscribe. Operator-approved wording pending; not reviewed by counsel.
Text Alert Consent
- Version 1.0Effective 2026-10-03
Initial version. The opt-in for text alerts when a customer messages the member's business. Names LivingRGV as the sender and carries message frequency, rates, STOP, HELP, and links to the Terms and Privacy Policy.
Hub Usage Billing Acknowledgement
- Version 1.1Effective 2026-10-30
Adds AI usage. The acknowledgement a member ticks before Featured or nonprofit checkout now says texting, calling and AI usage in the LRGV Hub are billed separately by LivingRGV at our provider's usage rates plus 5%, from a prepaid balance that reloads automatically.
- Version 1.0Effective 2026-10-03
Initial version. The acknowledgement a member ticks before Featured or nonprofit checkout: texting and calling in the LRGV Hub are billed separately at cost by LivingRGV from a prepaid balance that reloads automatically.
