Terms of Service

These Terms govern your use of LivingRGV, a local business directory, events surface, and creator marketplace for the Rio Grande Valley, Texas. By using the service or creating an account, you agree to them.

Accounts

You must provide an accurate email address. You are responsible for activity under your account. We authenticate by emailed sign-in link or Google sign-in; there is no password to protect, but the email inbox tied to your account effectively controls it.

Business Listings

Claiming a listing. A substantial portion of the directory was compiled from publicly available sources. If you own or are authorized to represent a listed business, you may claim its listing. By claiming, you represent that you are authorized to act for that business.

Claim review. Every claim is reviewed before a listing changes hands. We approve businesses owned or operated in the Rio Grande Valley, including local franchise owners. We don't approve claims from national brands run from out-of-area corporate offices. We may ask for verification and may decline a claim at our discretion.

Choosing a paid tier during review. You can choose a paid tier while your claim is in review. Your card is saved and you authorize us to charge it when your claim is approved; the subscription then renews monthly until you cancel. If your claim is declined, you are never charged and your saved card is removed.

Your content. You retain ownership of the content you submit — descriptions, images, hours, links. You grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content for the purpose of operating and promoting the directory. This license ends when you remove the content, except for copies already distributed and for archival records.

Accuracy. You are responsible for the accuracy of the information you submit.

Directory Accuracy and Disclaimer

Directory information — including listings we compiled from public sources — is provided as is, without warranty of accuracy, completeness, or current availability. Hours change, businesses close, phone numbers get reassigned.

We do not endorse, vet, license-check, or guarantee any listed business. A listing is not a recommendation. Any transaction you enter into with a listed business is between you and that business. We are not a party to it and are not responsible for the goods or services provided, the outcome, or any dispute arising from it.

Inquiries and Lead Delivery

When you submit an inquiry to a business from its listing page, your name, email address, and message are delivered to that business. That is the purpose of the form and it is disclosed to you at the point of submission. Once delivered, the business's handling of your information is its responsibility, not ours.

Before you send, the form shows you exactly what will be sent and to whom, and asks you to agree. By sending, you consent to that business contacting you by email about your message. We record that consent with a timestamp and store the exact wording you agreed to, so the record describes what was on screen rather than what a policy says was.

We do not collect a phone number on this form, so nothing here is consent to be called or texted.

Requests shared with local businesses. When you submit a quote request on one of our trade pages or an estimate tool, you agree that LivingRGV may contact you by phone, text message or email about the request, and may share your name, phone number, email address and ZIP code with local businesses in that trade serving your area. Those businesses may include, but are not limited to, Featured members. Each request may be shared with a limited number of businesses, and there is no guarantee that every business receives each one. A message sent from a listing's own page still goes only to that business.

Subscriptions and Billing

Paid tiers unlock additional placement and features for a claimed listing. Subscriptions are sold and billed through Stripe. Prices and what each tier includes are described at the point of purchase.

Payment card details are handled by Stripe and never reach our servers.

Texting and Calling in the LRGV Hub

The Featured tier includes the LRGV Hub, a customer relationship management (CRM) tool powered by HighLevel.

Texting and calling are billed separately, by usage. Business texting (SMS) and calling are included in the Hub. The messages you send and the calls you make are charged separately from your subscription, according to how much you use them.

LivingRGV charges for usage. Usage is charged by LivingRGV, through our payment processor, at cost, plus payment processing fees: we pass on what your texting and calling cost us. HighLevel runs the Hub; it does not bill you.

How usage is paid. Usage is paid from a prepaid balance funded by your card (your Hub wallet). The balance reloads automatically when it falls below a minimum amount.

Rates. The underlying per-message and per-minute costs are set by carriers and by HighLevel, and we pass them on at cost. They are not stated in these Terms and can change without notice.

Unused balance. On cancellation, any unused Hub wallet balance is refunded on request.

Your messages and calls are your responsibility. You are responsible for making sure the messages you send and the calls you make from your Hub comply with the law and with carrier rules. That includes obtaining any consent the law requires before you text or call someone (for example, under the Telephone Consumer Protection Act), honouring opt-out requests, and completing any carrier registration required for your own business, such as A2P 10DLC registration. We may suspend your access to texting and calling for abuse or non-compliance.

Cancellation and Refunds

Subscriptions are billed monthly in advance and may be cancelled at any time. Cancellation stops future billing and takes effect at the end of the current billing period; the listing retains paid features until that period ends, then reverts to the free tier.

Deleting your account is an exception to the paragraph above. Cancelling a subscription leaves paid features active until the end of the period you have already paid for. Deleting your account cancels any active subscription immediately and forfeits the remainder of that period. If you want to keep paid features through a period you have already paid for, cancel the subscription and leave the account open rather than deleting it.

Payments already made are non-refundable, including for partial billing periods and for periods during which the subscriber did not use the service. LivingRGV may issue a refund at its sole discretion; doing so in any instance does not create an obligation to do so in any other.

Cancellation requests are submitted through the account dashboard or to support@livingrgv.com.

Deleting Your Account

Deleting your account removes your profile and cancels any active subscription immediately, as described above. Some records do not belong solely to you and are not deleted with it:

• Business listings you claimed revert to unclaimed and remain in the directory. They can be claimed again, by you or by someone else authorized to represent that business.
• Events you submitted remain published. They are public information other people rely on, and are kept with your name removed.
• Records of consent you gave are retained with your account link removed. A consent record that disappeared when an account closed would not be a record of anything.
• Claim history is kept only as an anonymous record that a claim was made on a listing and decided on a date. Your name, email address, phone number, and IP address are erased from it.

Creator Marketplace

Creator profiles. Creators may publish a profile with a portfolio, a short description, a city, and an optional rate range. Profiles are reviewed before publication, and we may decline, edit, suspend, or remove one under Moderation and Removal below. A creator profile is a separate account type from a business listing — claiming a listing does not create one, and having one does not claim a listing.

Paid membership. A creator profile is a paid subscription, billed monthly, and is cancelled through the billing portal. Cancellation and refunds work the same way as for business listings, described under Cancellation and Refunds below. What you retain permission to display of a creator's work does not extend past their subscription — see their portfolio licence, linked below.

How a creator grants us permission to show their work. Two separate agreements, given when a creator signs up, and each recorded against the exact version they agreed to:

• the Creator Portfolio Licence, which is required — it is the permission to display a creator's work on their profile and on the pages that lead people to it; and
• Creator Promotional Use, which is optional — it adds promotional and editorial use, including the rotating hero on the creators page. A creator can decline it and still join.

Those documents govern their subject matter. This section does not restate or narrow them.

Contacting a creator. Businesses can message a creator through the site to discuss hiring them. We pass the message along and store it so both sides have a record of it.

Hiring is between you and the creator, and we are not part of it. This is the most important thing in this section, so it is stated plainly:

• Any engagement, quote, scope, schedule, deliverable, revision, licence, or fee is agreed directly between the business and the creator. LivingRGV is not a party to it.
• No payment for creative work passes through LivingRGV. We do not process, hold, escrow, split, invoice, or release payment between a business and a creator. The only money we handle is the subscription a business or creator pays us for its own membership, and, for members with the LRGV Hub, texting and calling usage — see Texting and Calling in the LRGV Hub above.
• We do not guarantee the work. We do not vet, supervise, insure, or warrant any creator's skill, availability, licensing, insurance, conduct, or the quality, timeliness, or suitability of anything they deliver.
• We do not guarantee payment. We do not guarantee that a business will pay a creator, pay on time, or pay in full, and we have no obligation to collect, advance, refund, or make good any amount owed between them.
• Creators are independent — not employees, agents, contractors, partners, or representatives of LivingRGV, and they cannot commit us to anything.
• A dispute about the work or the money is between the business and the creator. We may, at our discretion, remove a profile or a listing under Moderation and Removal, but that is not a remedy for the dispute and does not resolve it.

Listing a creator is not a recommendation, endorsement, certification, or background check. Deciding who to hire, on what terms, is yours.

Events

Anyone may submit an event. Submissions are moderated before publication. We may decline or remove any submission.

Text Messages (RGV Weekly Deals)

The program. RGV Weekly Deals is a text-message program run by LIVINGRGV LLC. It sends weekend events and local deals, weekly on Thursday, to people who sign up for it. The messages come from our texting number.

How you join. You join by entering your mobile number on a LivingRGV sign-up form and ticking the box beside the program's consent statement. The box is not ticked for you. After you sign up we send you one text to confirm, and we send the weekly messages only after you reply Y. By joining you agree to receive the messages described here. Signing up is optional and is not a condition of using LivingRGV or buying anything.

Message frequency. 1 msg/week, plus a confirmation text. Message frequency can vary because your Y, HELP, STOP and START texts each get an automatic reply.

Message and data rates. Message and data rates may apply. They are charged by your mobile carrier, not by us.

Opt out (STOP). You can cancel at any time by replying STOP to any message. We honor a STOP immediately, and in any event within 10 business days. After you reply STOP you will get an automatic confirmation text from the mobile network and no further messages. A STOP ends all marketing texts from LIVINGRGV LLC to that number. You can also email support@livingrgv.com. To rejoin, reply START or UNSTOP.

Help (HELP). Reply HELP to any message for help, or email support@livingrgv.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

Eligible numbers. The program is for mobile numbers in the United States. You must be the subscriber or the customary user of the number you enter.

Consent is not a condition of purchase. You do not have to agree to receive texts to use LivingRGV, to list or claim a business, or to buy anything.

Your information. How we collect, use, keep and share your mobile number and your consent record is described in our Privacy Policy. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.

Changes and ending the program. We may change, pause or end RGV Weekly Deals at any time, for example to change the day or the content of the messages or the number they come from. If a change affects the consent you gave, we will ask you again before we send under the new terms. We may stop sending to a number at any time, for example if we believe the number does not belong to the person who signed up or the messages are not being delivered. You may stop at any time as described above.

Not guaranteed. Texts depend on your carrier and your phone. We do not promise that every message will arrive, or arrive on time.

Acceptable Use

Do not submit content that is unlawful, infringing, defamatory, deceptive, or that you lack the rights to submit. Do not claim a business you are not authorized to represent. Do not scrape, overload, or attempt to circumvent access controls.

Moderation and Removal

We may edit, decline, suspend, or remove any listing, event, image, profile, or account, at our discretion, with or without notice. We are not obligated to host anything.

Third-Party Links

The site links to third-party websites and booking tools. We do not control them and are not responsible for their content or practices.

Disclaimers and Limitation of Liability

The service is provided as is and as available, without warranties of any kind, to the fullest extent permitted by law.

Indemnification

You agree to indemnify LivingRGV against claims arising from content you submit, your use of the service, or your violation of these Terms.

Changes to These Terms

We publish a new version rather than editing a published one, and every prior version remains available at its own permanent URL. For material changes we notify registered users and, where the change affects the creator license specifically, require re-acceptance before continued use of the creator dashboard.
